These Terms and Conditions (“Terms”) govern your access to and use of the website https://testandtagcrew.com.au/ (“Website”) and the engagement of our professional safety compliance services, including electrical safety testing, fire protection checks, and digital reporting.

By accessing our Website, requesting a quote, or booking a service, you agree to be bound by these Terms. If you do not agree, please discontinue use of our site and services.

1. Definitions

• “Service” refers to any workplace compliance testing, including but not limited to portable appliance testing (AS/NZS 3760), RCD testing, fire extinguisher and safety testing (AS/NZS 1851), and first aid kit auditing provided by us.
• “Client” means the business, individual, or representative booking the services.
• “Technician” means the certified person or authorised representative deployed by Test & Tag Crew to complete the on-site testing.

2. Quotes and Bookings

• All quotes provided via our online form, email, or phone are based on information supplied by the Client (e.g., estimated item count, location, and workplace type).
• Quotes are valid for thirty (30) days from the date of issue unless specified otherwise.
• Final pricing is determined on-site based on the exact number of items successfully tested, tagged, or repaired. Travel fees or minimum callout charges may apply for sites outside standard metropolitan boundaries.
• All listed prices are exclusive of GST unless explicitly stated otherwise.

3. Client Obligations & Site Access

To ensure a safe, efficient, and thorough inspection, the Client must:

• Provide our Technicians with clear, unhindered, and safe access to all electrical appliances, fire equipment, and safety systems on the scheduled day.
• Ensure a site representative or supervisor is available to guide the technician or address any local workplace health and safety (WHS) protocols.
• Notify us at least 24 hours in advance if a booking needs to be rescheduled. Cancelation or postponement fees may apply for late notifications or locked sites.

4. On-Site Safety Testing & Defective Items

• All testing is conducted in strict accordance with relevant Australian Standards, including AS/NZS 3760 (Electrical) and AS/NZS 1851 (Fire and Safety Equipment).
• Any item that fails to meet safety requirements will be clearly fitted with a highly visible “FAILED” tag and isolated or brought to the immediate attention of the site supervisor.
• Test & Tag Crew is not liable for any pre-existing faults, mechanical breakdown, or system data loss that may occur as a normal consequence of standard electrical safety testing procedures.

5. Reports & Compliance Certificates

• Digital asset registers, testing logs, and branded compliance certificates are typically delivered electronically within the same day of job completion.
• We reserve the right to withhold digital reporting data and certificates until the corresponding invoice has been settled in full.

6. Payment Terms

• Invoices will be generated upon completion of on-site services.
• Payment terms are strictly Seven (7) Days from the invoice date unless a corporate credit account has been formally approved in writing prior to deployment.
• Overdue accounts may incur reasonable administrative collection costs or late payment interest.

7. Australian Consumer Law & Limitation of Liability

• Our services come with guarantees that cannot be excluded under the Australian Consumer Law. To the extent permitted by law, our liability for any breach of a non-excludable condition or warranty is limited, at our option, to re-performing the safety services or refunding the cost of the services.
• We are not liable for any consequential loss, loss of profit, business interruption, or penalties issued by WorkSafe/regulatory inspectors due to items modified, introduced, or neglected by the Client post-testing.

8. Website Content & Intellectual Property

All text, image assets, layouts, codes, and logos displayed on this Website are the intellectual property of Test & Tag Crew or its web developer and are protected by Australian copyright laws. You may not copy, reproduce, or repurpose any part of this Website for commercial use without express written consent.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Victoria.
